The Education (Wales) Measure 2009 (Commencement No. 1) Order 2011
EXPLANATORY NOTE
(This note is not part of the Order)
This is the first commencement Order made by the Welsh Ministers under the Education (Wales) Measure 2009 (“the 2009 Measure”). The Order brings section 20 of the 2009 Measure into force on the day after the day on which this Order is made.
The 2009 Measure amended Part 4 of the Disability Discrimination Act 1995, which related to discrimination in schools, to enable children themselves to make a disability discrimination claim to the Special Educational Needs Tribunal for Wales. The Equality Act 2010 repealed the Disability Discrimination Act 1995.
Section 20 of the 2009 Measure gives the Welsh Ministers the power to amend the 2009 Measure to remove the provisions that amended the Disability Discrimination Act 1995, and to insert instead corresponding and other appropriate provisions amending the Equality Act 2010.

The Welsh Ministers, in exercise of the powers conferred upon them by section 26 of the Education (Wales) Measure 2009([1]), make the following Order:
Title and interpretation
1.—(1)(1) The title of this
Order is the Education (Wales) Measure 2009 (Commencement No.1)
Order 2011.
(2) This Order applies in relation to Wales.
(3) In this Order—
“the 2009 Measure” (“Mesur 2009”) means the Education (Wales) Measure 2009.
Appointed day
2. Section 20 (powers on repeal and re-enactment of the Disability Discrimination Act 1995) of the 2009 Measure is to come into force on the day after the day on which this Order is made.
